Popular Motor Corporation owns and manages The Platform. ("PMC"), a licensed Mahindra dealer, located at #43/1b, DRC post, Bannerghatta Road, Opp. Sagar Apollo Hospital is located in Bangalore with the zip code 560 029.

The platform was designed and is regularly updated to inform the public about the different Mahindra products and services offered by PMC. Additionally, the website offers customers the convenience of booking Mahindra Vehicles online, registering on the website, making payments through a partnered gateway linked on the site, and accessing other services related to buying Mahindra Vehicles and accessories, such as requesting help with loan approval from banks.

The terms and conditions ("Terms of Use") govern your utilization of the Platform, its services, and tools, including relevant policies referenced herein. By simply using the platform, you will enter into a contract with Popular Motor Corporation, the platform's owner. These terms and conditions, along with the policies, control your interactions and establish your required duties with PMC.

Your ability to use the Service depends on you agreeing to and following these Terms. These Terms are applicable to all individuals who visit, use, or access the Services. By using the Service, you agree to follow these Terms and be legally bound by them. If you do not agree with any portion of the terms, you are not allowed to use the Service.

In these Terms of Use, "You" or "User" refers to anyone, natural or legal, who has agreed to be a buyer on the Platform through registration as a Registered User. The terms "Popular," "PMC," "We," "Us," and "Our" refer to Popular Motor Corporation and its affiliates.

By utilizing any of the services offered by Us on the Platform, You must adhere to the regulations, guidelines, policies, terms, and conditions specific to that service, which are considered a part of these Terms of Use. We have the right to change, modify, add, or remove parts of these Terms of Use at any time without prior written notice to you. Make sure to regularly check these Terms of Use for any updates or changes. By continuing to use the Platform after changes are posted, you are indicating acceptance and agreement with the revisions. As long as you follow these Terms of Use, we give you a personal, non-exclusive, non-transferable, limited privilege to access and utilize the Platform. By accepting these Terms of Use, whether impliedly or expressly, you also agree to abide by this website's User Policies, such as the Privacy Policy that may be updated periodically.

Account, Password, and Security for the User

Registration on the Platform is mandatory for all transactions or bookings made through the platform by the User. You need to provide certain personal information such as your name, pin code, mobile number, and/or email id during the registration process and confirm it with the OTPs sent to the provided mobile number and email id. Registration will occur only after verification of all contact information provided by the User.

If inaccurate information is provided or the pin code is not within Kerala or Karnataka, we may choose not to register the user.

When signing up for the Platform, the User agrees to receive emails, phone calls, or SMS texts from Us about their booking, transaction, or any activity on the Platform, as well as information about seasonal offers and new product launches provided by PMC.

If you utilize the Platform, it is your responsibility to keep your Display Name and Password confidential and to be accountable for all actions taken under your Display Name and Password. If you give false, incorrect, outdated, or incomplete information, we can suspend, terminate, or block your account on the Platform indefinitely. You must inform us promptly if there is any unauthorized use of your password or account and make sure to log out of your account after each session.

This website enables a User who has signed up to access the services provided by Us:

Create an account for a User on the platform.

Explore the vehicles and accessories for sale from the well-known Mahindra brand, which are currently in stock in the chosen areas.

Reserve a Popular Mahindra vehicle by paying in advance.

Choose to either make a partial payment or pay off the balance for the purchase of a vehicle using any of the payment options offered by our payment gateway partner, BillDesk.

Submit all necessary and required legal paperwork for the vehicle's RTO registration.

Request loan assistance by submitting necessary information and documents like ID proof, address proof, income statement, and any other required information. Any information and paperwork you provide will be kept confidential by us. We will use it solely to help you secure a loan for your vehicle, and will only share it with banks or financial institutions when needed.

Access and exit the Platform (at your discretion) to check the status or progress of your booking, transaction, or loan approval request.

Guidelines and regulations for users on the Platform:

You are not allowed to provide a fake email address, pretend to be someone else, or deceive us in any way by using different addresses and phone numbers or engaging in fraudulent activities. You cannot act as if you are someone else or falsely claim to represent another person or entity.

Using any automated tool or manual method to access, copy, or monitor any part of the Platform or its content, or to bypass its structure or presentation, is strictly prohibited. This includes deep-linking, page-scraping, and using robots or spiders to obtain materials not intentionally provided by the Platform. We have the right to prohibit any such activity.

Trying to access parts of the Platform without permission, as well as any connected systems or servers, using hacking or unauthorized methods, is prohibited.

Disclaimer of Jurisdiction (Sale restricted to Kerala and/or Karnataka only)

PMC is solely authorized to sell and provide services for Mahindra vehicles in Kerala and Karnataka. Hence, unless stated otherwise, the items and services offered on the Platform are intended for sale only in Kerala or Karnataka. PMC does not claim that the materials in the Platform are suitable or accessible for use in any other States/Countries.

Declaration regarding Intellectual Property

The Mahindra brand trademarks and intellectual property rights, such as the logo, product design, text, and images, are owned by Mahindra AG in Mattaghofen, Austria. Permission was obtained from the owner to display them on this Platform.

The Popular brand logo, text, images, graphics, and code on this site, along with other trademarks and intellectual property rights, are owned by PMC or its group companies or mentioned third-party providers.

Unless stated otherwise, you are allowed to view, copy, and print the Content for personal use. Ensure all copies and print-outs include the displayed copyright and proprietary notices. We have the authority to alter the Contents whenever we choose, but we are not required to do so.

Except for what was mentioned previously, the Site and its Contents cannot be altered or copied in any way, such as framing, incorporating into other websites, or creating derivative works. Our prior written permission is necessary for any other website to include links to the Site. No trade marks or intellectual property belonging to Mahindra, PMC, or any of its group companies can be used without permission from the owner.

Except as mentioned earlier, nothing on the Site should be interpreted as giving any right or license. We cannot assure you have the right to use third-party owned content on the Platform without their permission being necessary. Without prior permission, you are not allowed to alter or remove any copyright or author attribution notice on the Contents.

Warranties and liability are disclaimed.

The materials, products (such as software), and services available to you on the Platform are provided as they are and are available without any guarantees, except as specified in writing. PMC cannot guarantee that the Platform will always be accessible or that all information on the Platform is accurate and complete.

We cannot guarantee the accuracy, completeness, reliability, currentness, or error-free nature of product descriptions or other content on the Platform and are not liable for any inaccuracies.

Every item sold on the Platform is subject to various state regulations. If we cannot deliver a product due to legal restrictions, we will refund or credit the amount received in advance for that specific item.

When placing an order on the Platform, you must provide a valid phone number. When you provide us with your phone number, you give us permission to contact you through phone calls and/or SMS messages for updates on your booking or other related information. We can also utilize this contact information to inform you about seasonal promotions and upcoming product releases.

Termination

Access to our Service can be terminated or suspended without warning or responsibility for any reason, such as violating the Terms. All aspects of the Terms that are meant to continue after termination will stay in effect, such as ownership rights, warranty disclaimers, indemnification, and liability limitations.

The Platform might have links to third-party websites or services that are not owned or controlled by Us. We do not have authority over, and do not accept liability for, the content, privacy policies, or practices of any third party websites or services. You also recognize and agree that PMC is not responsible for any damage or loss resulting from the use of any content, goods, or services on any websites or services linked to or provided by PMC.

Compensation for loss or damage.

You must compensate and protect PMC, its owner, licensee, affiliates, subsidiaries, group companies (as applicable), and their respective officers, directors, agents, and employees from any claims, demands, or actions, along with reasonable attorney fees, made by third parties, or penalties imposed because of your violation of the Terms of Use, Privacy Policy, other Policies, laws, rules, regulations, or the rights (including intellectual property rights) of a third party.

Law that governs

The terms will be governed by Indian laws without considering conflict of laws principles, and any disputes will be under the jurisdiction of courts, tribunals, or authorities in Karnataka or Kerala, as appropriate.
